How to Play:

1. It’s FM Sportsradio 104.3 The FAN’s “2008 FAN Football Pick‘Em” contest! You could win great weekly prizes and maybe even the Grand Prize of an LG 42” LCD HDTV, and a recliner to watch the game in from American Furniture Warehouse! To play log onto www.fm1043thefan.com.

2. Participants submit their picks of which team will win each NFL professional football game each week during the regular season. Picks may only be submitted via the www.fm1043thefan.com website.

3. Participants must register to be a FAN Insider to enter the contest. Each participant may submit their picks only once per week (although picks may be revised until the deadline for that week).

4. After picks have locked for a particular week, a participant will not be able to change or alter their
Picks.

5. Entries under alias, nicknames, maiden names, initials etc. will automatically be disqualified.

6. Weekly prizes will be awarded each week. (1st prize) $40 in food/drink gift certificates and $50 in game cards to ESPN Zone (2nd Prize) A $50 gift certificate to Bill’s Sports Collectibles.

7. The tie-breaker each week is the combined score of the designated game. In the event a tie still exists, a random drawing will be conducted to determine the weekly winners.

8. If the NFL decides to change the outcome of a game, we will still honor the original outcome of the game as decided on the field at the conclusion of the game.

9. A Grand Prize will be awarded following the completion of the 2008 NFL Regular Season, to the entrant with the highest point total in “The 2007\8 FAN Football Pick’Em” Contest. In the event of a tie for the Grand Prize, the participant’s whose season-long combined, predicted designated game scores is closest to the actual, season-long combined designated game scores will be the winner. Should there still be a tie, a random drawing will be conducted of all the players tied for first to determine the Grand Prize Winner.

10. Prizes will be awarded as follows:
- 1st Overall Highest Point Total (Grand Prize): an LG 42” LCD HDTV, and a recliner to watch the game in from American Furniture Warehouse!
- Total Estimated Value of Grand Prize: (INSERT VALUE HERE) 
- 2nd Overall Highest Point Total: A football party for four people at ESPN Zone in Denver including $200 in food and non-alcoholic beverages and $100 in game cards (Not to exceed $200 in food and non-alcoholic beverages. 13. Contest is offered only to legal U.S. and Colorado residents age 18 and over at the time of participation. One winner per household. Prizes are non-transferable by winners. Employees of FM Sportsradio 104.3 The FAN (KKFN-FM Radio), Lincoln Financial Media Company of Colorado, Lincoln Financial Media Company, Lincoln National Corporation, Riviera Black Hawk Casino, Smithwick’s Irish Ale, DIAGEO-Guinness USA, American Furniture Warehouse, ESPN Zone, Bill’s Sports Collectiand other sponsors, their parent, subsidiary, and affiliated companies, and their advertising or promotional agencies (collectively, the “Contest Entities”), and the immediate families or members of the same households of such individuals are not eligible. Employees of other Denver Metro Radio/TV Stations their parent, subsidiary, and affiliated companies, and their advertising or promotional agencies, and the immediate families or members of the same households of such individuals are not eligible. The term “immediate family members” include spouses, grandparents, parents, siblings, children and grandchildren. No groups, clubs, or organizations may participate in this Contest or reproduce or distribute any portion of these rules to their members. Proof of age, identity, and eligibility must be furnished to FM Sportsradio 104.3 The FAN (KKFN-FM Radio) upon request. All entry form information must be complete and accurate. FM Sportsradio 104.3 The FAN (KKFN-FM Radio) will not award a prize to anyone not meeting eligibility requirements at the time of entry. Winners of a major prize (anything valued at $599) FM Sportsradio 104.3 The FAN (KKFN-FM Radio) contest within the past 6 months are not eligible. FM Sportsradio 104.3 The FAN (KKFN-FM Radio) reserves the right to disqualify any entrant if these Contest rules are not followed. 14. Military Exemption Clause: In the case of Active Military (United States Armed Forces) employees, who are based in Colorado but do not claim Colorado as their official residence on their Federal/State IRS Tax Forms are exempt from the Colorado Residency clause. Active Military based in Colorado do not need to be a legal resident of Colorado, however they must be based in Colorado under their US Armed Forces orders with the expectation that they will remain in Colorado for at least 6 more months.

15. Limit one winner per household. Incomplete entries are void. Winners will be notified by phone, email, or mail by an official representative from FM Sportsradio 104.3 The FAN (KKFN-FM Radio). Prize winnings will come in the form gift certificate and/or actual prize will bear the date of issue and the date of expiration. Winner will be responsible for any additional delivery charges, installation and other cost associated with the prize components. Expiration dates will not be extended, and will not be refundable or redeemable for cash or credit at any time, nor will items be replaced if lost or stolen. Items may not be sold to a third party. No substitutions are allowed.

16. Winners will be contacted by an official representative(s) from FM Sportsradio 104.3 The FAN (KKFN- FM Radio) on how, when and where to receive their prizes. FM Sportsradio 104.3 The FAN (KKFN-FM Radio) is not responsible for incomplete, incomprehensible, illegible, or out-of-service contact information. If FM Sportsradio 104.3 The FAN (KKFN-FM Radio) is unable, after making a reasonable effort, to contact a winner, that winner will be disqualified and another name may drawn from all the qualified eligible entries received.

17. All charges, fees, and costs not specifically included in the applicable prize descriptions are the responsibility of the respective Prize Winner and his or her guest if applicable. FM Sportsradio 104.3 The FAN (KKFN-FM Radio) reserves the right to substitute prizes of equal or greater value. Odds of winning depend on the number of eligible entries received.

18. A portion of the prizes must be claimed by on a specific date to be determined by FM Sportsradio 104.3 The FAN (KKFN-FM Radio) at the FM Sportsradio 104.3 The FAN (KKFN-FM) business offices at 7800 East Orchard Road, Suite 400, Greenwood Village, CO. 80111. To claim the prize, winners must provide a valid Colorado state issued driver’s license or state identification card. Prizes not claimed by the claim date will be forfeited.

19. Participants are responsible for complying with all applicable federal, state, and local laws and regulations and with these Contest Rules, and by entering, participants agree to be bound to these Contest Rules. Any security breach or other attempt by an entrant or other party to tamper with the proper administration of the Contest will disqualify the entrant and may result in civil or criminal action against the entrant or other party and may result in the discontinuation, suspension, or cancellation of the Contest. Winners and entrants agree, except where prohibited by law, to release and discharge, hold harmless and indemnify FM Sportsradio 104.3 The FAN (KKFN-FM Radio), Lincoln Financial Media Company of Colorado, Lincoln Financial Media Company, Lincoln National Corporation, and other sponsors, their employees, agents and representatives, officers and directors and their immediate families, successors and assigns, and all others associated with the development and execution of this Contest, from any and all tax liability that may be imposed or associated with receipt or use of the prizes, and from and against any and all claims, actions, proceedings, and liability for any damages, expenses, fees, injury or losses (INCLUDING PERSONAL INJURY OR DEATH) sustained in connection with the receipt, ownership, or use of the prize or while traveling to, preparing for, or participating in any Contest-related or prize-related activity. By entering the Contest or by winning, participants grant to FM Sportsradio 104.3 The FAN (KKFN-FM Radio), Lincoln Financial Media Company of Colorado, Lincoln Financial Media Company, Lincoln National Corporation, and other sponsors, the right to publicize the participant’s name, photograph, image, likeness, voice, statements, and biographical information for advertising, trade, and promotion purposes without compensation and without opportunity for review, except where prohibited by law. Winners must execute an affidavit of eligibility and liability and publicity release. FM Sportsradio 104.3 The FAN (KKFN-FM Radio) retains the discretion to make all decisions regarding the Contest and interpretation of the Official Rules. All such decisions made by FM Sportsradio 104.3 The FAN (KKFN-FM Radio) are final and discretionary. In the event the selected winner(s) of the prize are/is ineligible or refuse(s) the prize or in the event the prize is forfeited for any other reason, the prize will be forfeited and revert back to FM Sportsradio 104.3 The FAN (KKFN-FM Radio). The laws of the State of Colorado shall govern this Contest, without regard to Colorado’s choice of law rules. The courts of Colorado shall be the exclusive forum for any dispute relating to these Rules and/or this Contest. All participants and winners agree, by their participation in the Contest, to submit to the personal jurisdiction of the courts of Colorado. For prizes valued at $599 or greater, winner must provide his or her Social Security Number for tax purposes. Prizes may be considered income, and any and all taxes associated with prizes are responsibility of winner.

20. Disclaimer and Force Majeure. The Contest Entities and other sponsors, their affiliated, parent, and subsidiary companies, their employees, agents and officers, advertising and promotion agencies, and all others associated with the development and execution of this Contest are not responsible for: (1) problems associated with television transmission, radio transmission, cable transmission, satellite transmission, phone lines, facsimile, or cable lines and/or phone or IP numbers that are beyond their control—this includes, but is not limited to: a busy signal, operator interference, cellular interference, Internet congestion, technical or atmospheric conditions that disrupt the completion of a phone call, facsimile transmission, email transmission, or cable modem service, or other Internet interruptions or malfunctions or for technical difficulties which may prohibit, prevent, or interfere with the transmission of television or radio signals to all or limited geographic areas during the playing of the Contest or that may prohibit, prevent, or interfere with the submission of an entry form; delays due to streaming, failures of or other problems relating to computer hardware, software, the Internet, or similar systems, including but not limited to difficulties relating to contestants’ ISP, DSL, or cable modem access, “worms,” or viruses; (2) typographical errors in any materials relating to the Contest; (3) lost, misdirected, illegible, incomplete, or delayed entry forms; (4) cancellations, postponements, or delays; (5) Acts of God, war, terrorism, government regulation, disaster, fire, strikes, civil disorder, or other similar causes beyond the control of the Contest Entities and other sponsors, their affiliated, parent, and subsidiary companies, advertising and promotional agencies and their immediate assigns, making it inadvisable, illegal, impossible, or impractical to continue the Contest or to perform under these Rules. The Contest Entities and other sponsors, make no warranty, guarantee, or representation of any kind concerning any prize, and Contest Entities specifically DISCLAIM ANY IMPLIED WARRANTY OF MERCHANTABILITY, WARRANTY OF FITNESS, AND ANY OTHER IMPLIED WARRANTY.
